Divorcing baseball star ''has a pre nup''

Alex Rodriguez, the US baseball player recently linked with pop star Madonna, has a pre-nuptial agreement with his wife Cynthia, it has been revealed.

The New York Yankees hitter, 33, has received divorce papers from his spouse, amid allegations of an extra-marital affair, but under US law Cynthia Rodriguez may have a limited claim to his estate.

Unlike in the UK, pre-marital waivers are binding upon those making provision for the distribution of assets in the event of divorce.

Mr Rodriguez is reported to have admitted that his marriage is "irretrievably broken" and will rely on the pre-nuptial agreement signed voluntarily a month before the couple''s 2002 wedding.

His wife has made a claim for the pair''s £6 million mansion, two daughters and a share of his earnings over the last six years, while the sports star wishes for a co-parenting arrangement.

The Law Commission is currently be discussing the merits of making pre-nuptial agreements binding in UK law, upgrading them form a current status where judges may, but are not obliged to take them consideration.
